Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No.44 dated 09.07.2018, registered under Sections 380, 427, 323 and 34 IPC, Police Station Sadar Budhlada, District Mansa (P-1) and all subsequent proceedings arising therefrom, on the basis of compromise (P-2).
Pursuant to order dated 08.04.2019 of this Court, the parties appeared before the trial Court on 14.05.2019 along with receipts of `15,000/- to get their statements recorded. Learned Sub Divisional SONIKA 2019.05.24 09:46 I attest to the accuracy and authenticity of this document Chandigarh
CRM-M-16076 of 2019 --2-- Judicial Magistrate, Budhlada, has submitted his report vide letter bearing No.68 dated 18.05.2019 duly forwarded by learned District and Sessions Judge, Mansa, vide letter bearing No.3641 dated 20.05.2019. According to the report, ld. Sub Divisional Judicial Magistrate, Budhlada, is satisfied that compromise has been voluntarily entered into between the parties. The compromise appears to be genuine and without any pressure or coercion. No accused has been declared as proclaimed offender.
Considering the report of ld. Sub Divisional Judicial Magistrate, Budhlada, dated 18.05.2019 and the fact that the compromise will bring peace and harmony in relations between the parties, aforesaid FIR No.44 dated 09.07.2018 along with all subsequent proceedings arising therefrom, is quashed qua the petitioners only.
Disposed of accordingly.
