M.M.S. BEDI, J. (ORAL) The petitioner is a complainant who is aggrieved by the release of three accused who were arrested in FIR No.18 dated 11.2.2015, under Sections 302, 148, 149 and 120-B IPC read with Section 25 of the Arms Act, registered at Police Station Uklana, Distict Hisar.

A perusal of impugned order indicates that the presentation of challan was awaited when the order was passed for release on 6.5.2015. It is observed that release of the three accused under Section 169 Cr.P.C., will not, in any manner, prejudice the legal rights of the complainant/victim under Section 193 or 319 Cr.P.C. and the right of the complainant to file a protest petition on receipt of notice from the Court of competent jurisdiction or to avail the remedy of filing a complaint against the persons who are alleged to be

CRM-M-30507-2015 (O&M) involved in the case.

In view of established legal remedies available to the petitioner and without prejudice to the rights of the petitioner to avail any of the said remedies, this petition is disposed of as withdrawn at the request of counsel for the petitioner. (M.M.S.BEDI) JUDGE September 18, 2015.
