Prayer in the present petition filed under Section 438 Cr.P.C., is for grant of anticipatory bail to the petitioner, in case bearing FIR No.311 dated 01.11.2022 registered under Section 506 IPC at Police Station Sector 65, Gurugram, Haryana.

On 12.10.2023, following order was passed by this Court:- "Upon instructions received from Inspector, Vinod Kumar, State counsel submits that pursuant to interim order dated 28.08.2023 passed by this Court, petitioner has joined and cooperated with the investigation. Still further, he submits that the petitioner is no longer required for custodial interrogation.
However, as per office report, notice could not be issued to respondent No.2 as process fee has not been filed. Let fresh notice be issued to the unserved respondent for 12.12.2023 on deposit of necessary charges.

Learned State counsel on instructions from the Investigating Officer of Police Station Sector 65, Gurugram, Haryana submits that in compliance of order 28.08.2023, the petitioner has already joined the investigation and is not required for any further investigation.

Having considered the aforesaid facts and circumstances, the petition is allowed. Order dated 28.08.2023 passed by this Court, is hereby made absolute. However the petitioner shall keep on joining the investigation as and when called upon and shall abide by all the conditions as envisaged under Section 438(2) Cr.P.C.
