After hearing learned counsel for the parties and going through the record, it appears that the petitioner has been involved in the case on the basis of the material that he had purchased the robbed articles, which were recovered from him. It will certainly be a debatable issue whether the possession of iron rods recovered, could be presumed to have been sold to the petitioner or he connived with the main accused in committing dacoity. Taking into consideration the fact that the petitioner has been in custody since 25.12.2013,the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial court.
