Status report by way of affidavit of Sh. Sukhbir Singh, Assistant Commissioner of Police, Badkhal, District Faridabad has been filed. The same is taken on record.
This Court briefly quizzed the petitioner, who informed that she had filed the instant petition mainly to ensure that no harm is caused to Ram Babu with whom she was in love and that she never knew that she would be confined in some institute. While recording the statement, the brother of the petitioner who was present in the Court had been asked to go out of the Court room and the petitioner was specifically asked as to whether she was under any kind of pressure or has been coerced to give said statement, which she denied categorically and stated that she does not apprehend any kind of threat to her life and liberty from anybody.
Shri Pal Karhand, Chairperson, Child Welfare Committee, is present in person and has filed a brief reply wherein it has been stated that he had handed over the custody of the petitioner to her parents as she had given in writing that she wishes to go her home with her mother. It has also been stated therein that after two days she was lodged back in Sos-Green field (institute being run by NGO). Shri Pal Karhand is present in person and has expressed that he was not aware about the implications of the matter and has apologized and stated that he shall be more careful in future and that his intention was never to disobey or to cause any undue benefit to anyone. In view of the aforestated position i.e. the statement of petitioner and also the reply filed by Shri Pal Karhand, Chairperson, Child Welfare Committee, the explanation as submitted by Shri Pal Karhand, is accepted and no further action is required to be taken in the matter. The petitioner would be free to accompany her brother to her home. The petition stands disposed of accordingly.
