This is third petition filed under Section 439 Cr.P.C. seeking concession of regular bail to the petitioner in a case FIR No. 0089 dated 31.10.2019 under Section 363, 366-A, Section 34 of the Indian Penal Code, 1860 and Section 3, 4 of the Protection of Children from Sexual Offence Act, 2012 (Section 120-B of the Indian Penal Code, 1860 added later on and Section 3, 4 of the Protection of Children from Sexual Offence Act, 2012 deleted later on) registered at Police Station Mallanwala, District Ferozepur.

Learned counsel for the petitioner submits that the petitioner has been in custody since 31.10.2019. The trial is not likely to conclude in the near future as subsequent to the conclusion of the prosecution evidence after recording of statement under Section 313 Cr.P.C., the prosecution has now moved an application under Section 311 Cr.P.C. for re-examination/ further examination of the prosecutrix, which is still pending consideration and has not yet been decided by the trial court. Crl. Misc. No.M-19841 of 2021 -2In view of the allegations levelled in the FIR in question against the petitioner regarding enticing and kidnapping the prosecutrix, this Court is not inclined to extend the concession of bail to the petitioner. However, as the petitioner has been in custody for almost 01 year and 08 months, the trial court is directed to dispose of the application filed under Section 311 Cr.P.C. at the earliest.

Disposed of in the above terms.
