(Oral) The petitioners have approached this Court seeking protection of their life and liberty on the premise that petitioner No.1 has performed marriage with petitioner No.2 against the wishes of her parents and other family members and the petitioners are apprehending threat to their life and liberty at their instance. Notice of motion.

Mr. K.S. Sidhu, DAG, Punjab, Punjab accepts notice on behalf of the respondent - State.

Learned counsel for the petitioners has submitted that petitioner No.1 - Harpreet Kaur was earlier married to one Jagtar Singh who has died in an accident. The petitioner No.1 has 03 minor children who are living in her care and custody. The petitioners alleged that they have performed married on 14.08.2017 and now, the petitioner No.1 is facing threat to her life and liberty at the instance of respondents No.4 and 5 who are the parents of Jagtar Singh, husband of petitioner No.1 Mohd. CRM No.M-30587 of 2017 (since deceased). Learned counsel for the petitioners has further submitted that a representation dated 17.08.2017 was made to the Senior Superintendent of Police, Mohali (Annexure P5) seeking necessary protection but no action has been taken so far in the matter. Heard.

Without examining the question of validity or otherwise of marriage of the petitioners, the present petition stands disposed of with a direction to the Senior Superintendent of Police, Mohali to look into grievance of the petitioners expressed in the representation (Annexure P5) and take appropriate action, if any, warranted in the circumstances. This order shall not be construed to be conferring the legitimacy or authenticity to the factum of marriage having been performed as well as the age, as the Court is already deprived of any means to determine the aforesaid facts.
