Petitioner has filed this petition under Section 482 Cr.P.C. against State of Punjab and other respondents for quashing impugned orders dated 05.07.2017 passed by learned trial court vide which application filed by the petitioner for taking action against Gurbax Singh for giving false affidavit, was dismissed.
I have heard learned counsel for the petitioner and have gone through the record.
From the record, I find that the petitioner filed application before learned trial court for taking action against Gurbax Singh and to cancel the bail granted to Baljinder Kaur accused. It is stated in the application that Gurbax Singh, who stood surety for Baljinder Kaur on 21.04.2016, has already stood surety in case FIR No.15 dated 16.02.2015 in Vineet Gulati 2017.08.30 14:22 I attest to the accuracy and authenticity of this document Chandigarh a sapurdari application but in his affidavit dated 21.04.2016, he has
CRM No.M-30590 of 2017 -2specifically deposed that he has not stood surety for any other person. Learned trial Court, after hearing the parties, held that there is no wrong averment as Gurbax Singh has not stood surety for any other person, rather, he has given the surety for the vehicle and the application was dismissed. Otherwise also, there is no bar that a person cannot stand surety for two persons. If a person is having sufficient properties, he can stand surety for more than one person.
In view of the above discussion, I find that no illegality has been committed by learned JMIC, Khanna while passing the impugned order dated 05.07.2017.
Therefore, finding no merit in the present petition, the same is dismissed.
