-.- JAISHREE THAKUR J. (ORAL) The instant writ petition has been filed seeking quashing of the finding report dated 24.03.2021 (Annexure P-12). During the pendency of instant writ petition, a regular departmental enquiry had already been held and the petitioner has been punished with stoppage of five future annual increments with permanent effect vide order dated 23.02.2022. The limited prayer of the petitioner herein is that he may be permitted to represent to the department for reinstatement in service, as he is under suspension since 04.09.2020 i.e. for more than two years and is only being paid subsistence allowance, equivalent to 50%, which has not been enhanced during the pendency of the proceedings.
I have heard learned counsel for the petitioner and in view of the fact that the finding report became a subject matter of regular departmental enquiry culminating in punishment having been awarded to the petitioner, this writ petition is no longer sustainable. Consequently, the instant petition stands disposed of, as having been rendered infructuous. PANKAJ KUMAR 2022.10.
