**** RITU BAHRI, J. (Oral) Present petition is for release of petitioner on regular bail in FIR No.101 dated 16.04.2016, under Sections 323, 342, 366, 346 and 506 IPC, registered at Police Station Rai, District Sonepat. Learned counsel for the petitioner submits that as per the allegations contained in the FIR the complainant's daughter had left her house without telling to anyone. He further submits that as per marriage certificate and photograph (Annexurs P-1 & P-2), the petitioner had performed marriage with the daughter of the complainant, who was major at that time.
Learned State counsel has not disputed the above-said fact. In a statement of prosecutrix recorded under Section 164 Cr.PC (Annexure P-9), she has supported the version of the FIR. CRM-M-31482-2016 -2have already been framed and now out of total 9 witnesses, 5 has since been examined.
I have heard the learned counsel for the parties and with their able assistance gone through the material available on record. The petitioner was arrested on 16.04.2016. Since then, he is in judicial custody and no useful purpose would be served to further detain him in jail. The final conclusion of trial will take a long time. In view of above facts, the present petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing adequate bail bonds and surety bonds to the satisfaction of learned trial Judge/Duty Magistrate, Sonepat.
Needless to mention that, nothing observed here-in-above, would reflect, on merits in the trial of the main case, in any manner.
