IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH 2024:PHHC:047847 CWP No.8087 of 2024 Date of Decision:09.04.2024 Kanwaldeep Singh ....Petitioner vs.

Union of India and others ....Respondents

CORAM:

HON'BLE MR. JUSTICE JAGMOHAN BANSAL

Present:

Mr. G.S.Ghuman, Advocate and Mr. Atul Kumar, Advocate for the petitioner Ms. Neha Sharma, Senior Panel Counsel for the Union of India Mr. Aman Dhir, DAG, Punjab *** JAGMOHAN BANSAL, J. (ORAL) 1.

The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of notice dated 22.11.2023 (Annexure P-1) whereby respondent has called him to show cause as to why his passport be not impounded on account of suppression of material facts. 2.

The petitioner concededly has not filed reply to the aforesaid notice and respondent till date has not adjudicated said notice. 3.

Mr. G.S.Ghuman, Advocate, submits that cancellation report has already been filed, thus, passport cannot be impounded on the ground of pendency of FIR.

CWP No.8087 of 2024 -2- 2024:PHHC:047847 4.

The petitioner has not made his submissions before passport authority. This Court is sanguine of the fact that passport authority would pass an appropriate order after considering his submissions. 5.

In view of the above, the petition stands disposed of with liberty to the petitioner to file response to the afore-stated show cause notice. (JAGMOHAN BANSAL) JUDGE 09.04.2024 paramjit Whether speaking/reasoned: Yes Whether reportable:
