[1] Today physical hearing was held but on request of learned counsel for the petitioner, the matter is taken up by way of hybrid hearing.

[2] These three petitions under Section 439 Cr.P.C. are filed seeking regular bail in FIR No. 11, dated 16th April, 2021, under Section 7 of the Prevention of Corruption Act, 1988 (amended vide Act of 2018) read with Section 120-B IPC, registered at Police Station Vigilance Bureau, Patiala Range, District Patiala. [3] As per the allegations in the FIR, police officials including the petitioners demanded money from the complainant for helping his nephew in FIR No. 71/2021. Virsa Singh (petitioner in CRM-M-235082021) was caught red handed accepting the money. [4] Learned counsel for the petitioners submits that petitioners are in custody since 16th April, 2021, investigation is complete, complainant has been examined and no recovery is to be made. It is further submitted that all the petitioners have been suspended from service.

[5] Learned State counsel opposes the grant of bail. [6] Considering the facts and circumstances in totality

-3especially that no recovery is to be made, investigation is complete, complainant has been examined and they are in custody since 16th April, 2021, the petitioners are granted regular bail subject to furnishing bail bonds to the satisfaction of the Chief Judicial Magistrate/ Duty Magistrate concerned.

[7] The petitions are allowed.

[8] It is clarified that nothing stated hereinabove shall be construed as an expression of opinion on the merits of the case. [9] Photocopy of this order be placed on the files of connected cases.
