*** H.S. Grewal, J. (Oral) This is a petition for anticipatory bail filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, (BNSS), 2023 in case bearing FIR No.337 dated 15.12.2024 under Sections 406, 420 IPC, registered at Police Station Ding, District Sirsa.

Learned counsel for the petitioner contends that the petitioner has been named as an accused in the aforementioned FIR. It has been alleged that the petitioner alongwith the co-accused had accepted an amount of Rs.95,000/- on the pretext of sending the sister of the complainant to Canada for higher education on behalf on agency named "Dream to Destination Agency". Counsel for the petitioner further submits that an amount of Rs.95,000/- was credited in the account of Poonam who is running the Agency. It is further stated that since the file/ case of the complainant's sister was rejected, an affidavit was given by Poonam wife of Gurpreet Singh admitting receiving of the amount and further assuring that she will return the same.

CRM-M-15473-2025 -2to appear before the Investigating Officer and join investigation and in the event of his arrest, he was ordered to be released on ad-interim bail to the satisfaction of the Investigating/Arresting Officer, subject to the conditions envisaged under Section 438(2) Cr.P.C.

Learned State counsel states that the petitioner has joined the investigation and is not required for custodial interrogation. 5.

In view of the submissions of learned counsel for the petitioner especially when the petitioner having joined investigation, the order dated 21.03.2025 granting interim bail to the petitioner is made absolute. 6.

However, the petitioner shall abide by the conditions stipulated under Section 438(2) Cr.P.C. He shall also join investigation as and when called upon to do so.

The petition stands allowed.
