Through this petition under Section 438 Cr.P.C., prayer has been made for grant of ad interim bail to the petitioner in case FIR No. 71 dated 27.05.2014 registered under Section 22 of the NDPS Act at Police Station Bilga, Tehsil Phillaur, District Jalandhar. 2.
Learned counsel for the petitioner contends that on account of non-appearance of the petitioner on 13.07.2017, his bail bonds and surety bonds were forfeited to the State by cancelling his bail and he was ordered to be summoned through non-bailable warrants. 3.
Considering the overall facts and circumstances, but without commenting upon the merits of the case, the petitioner is directed to appear before the trial Court on 07.09.2017, the date already fixed in the trial and would be admitted to ad interim bail subject to his furnishing appropriate bail bonds/surety bonds to the satisfaction of the trial Court. However, it is clarified that this order shall not be an embargo in conducting the proceedings against the petitioner under Section 446 Cr.P.C., by the trial Court.
