Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.49 dated 26.04.2018 under Sections 420 and 120-B IPC, registered at Police Station Chohla Sahib, District Tarn Taran.

Notice of motion was issued. Learned State counsel as well as learned counsel for the complainant appeared and contested the petition. I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. From the record, I find that FIR in the present case was got VINEET GULATI 2019.05.10 10:58 I attest to the accuracy and authenticity of this document Chandigarh registered against the present petitioner and others by complainant Gurnam

CRM No.M-31611 of 2018 -2Singh. As per the complainant, accused have committed fraud of `10 lakhs with him on the pretext of sending son of the complainant abroad. It is specifically mentioned that `90,000/- was deposited in the account of Paramjit Singh-petitioner.

As per the order dated 20.08.2018 passed by the Coordinate Bench granting interim bail, `90,000/- was ordered to be deposited by the petitioner in the Registry of this Court, which has been deposited. The petitioner has already joined the investigation. He is not required for custodial interrogation. No useful purpose will be served by sending and keeping the petitioner in custody till the disposal of the case. Keeping in view the facts and circumstances of the case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case, where the petitioner is entitled to benefit of anticipatory bail. Therefore, the present petition is accepted and the order dated 20.08.2018 granting interim bail to the petitioner, is made absolute.
