The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 2 to re-issue his passport.

The petitioner was issued passport on 27.01.2011 which expired on 26.01.2021. The petitioner vide application dated 18.08.2021 applied for re-issuance of passport with correct name of the petitioner as well as his spouse.

Learned counsel for Union of India, who on advance notice is present in Court, submits that there are adverse reports from police authorities, however, she assures the Court that an appropriate order considering mandate of the Passport Act, instructions issued thereunder and judgment of this Court in Mohan Lal @ Mohna vs. Union of India and PARAMJIT KAUR SAINI 2023.11.16 16:23 I attest to the accuracy and authenticity of this order/judgment

In case the passport authority comes to a conclusion that passport cannot be re-issued to the petitioner, an opportunity of personal hearing before passing order shall be granted. 4.
