This is a petition filed under Section 438 Cr.P.C. seeking pre-arrest bail in a case registered against the petitioner vide FIR No. 151 dated 04.09.2013 under sections 382, 323, 34 IPC at Police Station Division no. 4, district City Jalandhar. Learned counsel for the petitioner submits that petitioner could not appear before the trial court on one date i.e 03.04.2015 as he had noted a wrong date of hearing. Due to this reason, his bail bonds and surety bonds were cancelled. Resultantly, non-bailable warrants of arrest were issued. According to learned counsel, petitioner had been regularly appearing before the trial court and never intended to absent from the court proceedings. He submits that petitioner is ready to surrender before trial court and also furnish an undertaking that he shall not absent himself from court proceedings on any date in future. In view of above, petition is disposed of and it is directed that in case petitioner surrenders before the trial court within a week from today and applies for regular bail, his plea shall be decided on the same day.
