Naresh Kumar Sanghi, J.(Oral) Prayer in this petition, filed under Section 438, Cr.P.C., is for grant of anticipatory bail to the petitioner, Manish Kumar, who has been booked for having committed the offences punishable under Sections 406, 420 and 506 read with Section 34, IPC, in a case arising out of FIR No.9, dated 12.01.2015, registered at Police Station, Sadar, Tarn Taran. Learned counsel contends that the petitioner has falsely been implicated in the present case and he is neither required nor involved in any other case at present. I have heard learned counsel for the petitioner and with his able assistance gone through the material available on record. As per prosecution version, the present case was registered on the complaint of Kulwant Kaur. As per allegations, the petitioner and his co-accused charged an amount of `2,00,000/-(Rupees two lacs only) and also took into possession SEEMA RANI 2015.09.10 16:37 I attest the accuracy and authencity of the document
[2] the passbook belonging to the informant on the pretext that they would return the amount after making it double and as such, the petitioner and his co-accused not only committed cheating with the informant but also usurped her (informant) `2,00,000/-(Rupees two lacs only). The petitioner was also involved in the similar cases though as per learned counsel for the petitioner he has been acquitted in the said cases. The petition filed by the co-accused of the petitioner was dismissed as withdrawn from this Court vide order dated 07.08.2015.
No ground for grant of anticipatory bail to the petitioner is made out.
Dismissed.
