RAMENDRA JAIN, J. (ORAL) Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner Sandeep Kumar in a case arising from FIR No.0615 dated 22.12.2017 registered under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985. According to the prosecution, 90 strips containing Alprasafe 0.5 mg. Weighing 1 kg 800 grams and 220 strips of Tramadol Tricare-SR weighing 1 kg 130 grams, were recovered from the petitioner. Learned counsel for the petitioner inter alia contends that FSL report has not yet been received. Therefore, at this stage, petitioner cannot be declared as accused. Petitioner is in custody since 22.12.2017. In view of above, but without expressing any opinion on the merits of the case, the petitioner is granted interim bail subject to furnishing personal bonds and two sureties of `2.00 lakh each, to the satisfaction of Special Court concerned only till receipt of the FSL report. The petition stands disposed of accordingly.
