On 27.08.2024, this Court passed the following order:- "Counsel for the respondents has made a reference to the short reply filed by way of affidavit of Mr. Dushyant Singh, Senior Divisional Engineer-1/FZR, stating that an opening has been created in the wall to form a passage with a width of 3.80 meters for the use of the petitioner and other villagers. He submits that the grievance of the petitioner has been redressed.

In the interest of justice, adjourned to 04.11.2025. To be shown in the urgent cause list."

Counsel for the petitioner, who has appeared through virtual mode, has expressed an apprehension that the passage as is depicted from the photographs, Annexure R-2, appended with the written statement, filed on behalf of respondents No.1 to 7, is a temporary one. However, Mr. Shivoy Dhir, Senior Panel Counsel, has assured that the passage is a permanent pathway.

Perusal of the photographs show that although the passage has been provided, but it is a kacha passage.

Respondents are directed to metal it by using concrete or any other means, they deem appropriate after getting necessary approval, if required. 5.
