The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.90 dated 2.10.2017 registered for the offences under Sections 21, 22 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as `the Act') at Police Station Fatehgarh Panjtoor, District Moga. Notice of motion has been issued in this case. Mr. H.S. Grewal, learned Additional Advocate General, Punjab has appeared on behalf of the respondent-State and contested this petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. As per the allegations in the FIR, 260 Grams intoxicant powder Harpal Singh Parmar 2018.08.03 17:13 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-31698 of 2018 [2] containing Alprazolam and 2 Grams heroin have been recovered from the co-accused. The present petitioner has been nominated on the basis of disclosure statement that he had supplied the intoxicant powder etc. There are other FIRs against the present petitioner. Learned counsel for the petitioners states that in 8 FIRs, the petitioner has already been acquitted.

Keeping in view the facts and circumstances of the present case and in view of the fact that the present petitioner is required for custodial interrogation, I do not find it a fit case where the petitioner is entitled for the grant of anticipatory bail.

Therefore, finding no merit in this petition, the same is dismissed.
