Bhatia, Advocate, for the petitioner Mr. Rajiv Verma, DAG, Punjab --- SANDEEP MOUDGIL, J (ORAL) The instant petition under Section 438 Cr.P.C., has been filed for grant of anticipatory bail to the petitioner in FIR No.25 dated 30.4.2023, under Sections 326, 325, 324, 323, 307, 506 and 34 of the IPC, 1860 (Section 307 IPC deleted subsequently), registered at Police Station Khui Khera, District Fazilka.

Reply filed on behalf of the complainant, is taken on record, copy of which stands furnished to learned counsel for the petitioner. 3.

Having perused the record and given a thoughtful consideration to the submissions made before this Court, the material fact can be culled out of the facts as well as the FIR, that the material injury kirpan blow by Parkash, who is father of the present petitioner, is concerned that was declared simple in nature subsequently on medical examination. Subsequently Section 307 IPC stands deleted.

CRM-M No.17637 of 2024 -24. It is also evident from record that truth revolves around some property and maintenance and welfare of parents wherein appeal has also been preferred under Maintenance and Welfare of Parents and Senior Citizens Act, 2007, which is pending consideration. 5.

Mr. Rajiv Verma, DAG, Punjab, on a query put by this Court, on instructions from ASI Ranjit Singh, informs that the petitioner has joined the investigation pursuant to order dated 9.4.2024, whereby he was granted interim protection, who further states that custodial interrogation is not required at this stage.

In view of the above, this Court deem it appropriate to question as to whether custody of the petitioner is must particularly in a specific stand taken by the State. Hence, the order dated 9.4.2024 is made absolute.
