*** This petition for regular bail has been filed by petitioner Jeeta Ram @ Rinku, an accused in F.I.R. No. 46 dated 21.2.2018 for offences under Sections 458, 323, 506, 354A, 376/511 IPC and Sections 3(2)(v) and 3(2)(va) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities)Act, 1989 registered with Police Station Kaithal Sadar, Kaithal. Briefly stated the facts of the case as per prosecution story are that on 21.2.2018 at about 2.00 A.M. while victim along with her two children was sleeping in her room, her husband Vikram and father-in-law Bhulla Ram were sleeping in Verandah of the house then the accused entered in the room of the victim and bolted the room from inside and molested the victim. He tried to commit rape upon her. However, on alarm being raised by the victim her husband came there and saved the victim from the accused.

CRM-M No. 31716 of 2018 F.I.R. was registered. Accused was apprehended on the spot and handed over to the police. The statement of the prosecutrix was got recorded under Section 164 Cr.P.C. in which she repeated her version as given to the police. After completion of investigation challan against the accused has been filed. Charge has been framed against him and trial is going on. Out of 18 PWs 2 PWs have been examined. Accused had moved an application for regular bail which was dismissed by the Court of Sessions as such he has approached this Court craving of grant of similar relief. I have heard learned counsel for the petitioner and learned State counsel besides going through the record.
The allegations against the petitioner are very grave and serious of trespassing in the house of the complainant at night and attempted to commit rape upon a married woman who was sleeping in the room along with her children. Such type of acts cannot be taken lightly least that should encourage the other persons in treading the path of crime. The trial against the accused is going on. His guilt shall be determined during the trial which is likely to be concluded in near future. If granted bail, there is every apprehension of his absconding and even tampering the prosecution evidence.
