We have heard learned counsel for the rival parties at length. 2.

The fundamental grievance of the petitioner is that he has not been admitted in B.A. LL.B. (5 years) course at Panjab University Campus, Chandigarh. It is the contention of learned counsel for the petitioner that on account of an interim order passed by this Court on 29.09.2022 (Annexure P5) in Civil Writ Petition No. 22867 of 2022 filed by one Anshiv Berry, whose name found mention in the merit list, was permitted provisionally to participate in the counseling for B.A./B.Com. LL.B. (Hons.) 5 years integrated course at UILS, Panjab University Law Faculty Campus, Chandigarh. 3.

It is contended by learned counsel for the petitioner that if the interim orders had not been passed, the petitioner, who was No.1 in the waiting list, could have been adjusted and admitted to the B.A.-LL.B. 5 years integrated course.

In the aforesaid background, it is contended that the petitioner, who was No.1 in the waiting list should be treated as deemed to be admitted in University Institute of Legal Studies (UILS), Panjab University, Chandigarh and should thereafter be allowed to transfer in Panjab University Law Faculty Campus, Chandigarh i.e. UILS.

From the aforesaid facts and the claim made by the petitioner, it is obvious that at the time when the counseling and the admissions had taken place sometime in August-September-2022, the petitioner did not raise any grievance or cause by coming to this Court. It appears that the petitioner was awaiting the result of Civil Writ Petition No. 22867-2022 and was in fact a fence sitter. In the meantime, he was admitted in 5 years LL.B. course at Regional Centre, Ludhiana in academic sessions 2022-23. 7.

In view of the above, the petitioner not having raised his grievance before this Court at the relevant time when it arose, lost his right to do so after the course had commenced at Regional Centre, Ludhiana as well as at UILS. Thus, the present case in actuality is a simple case seeking an inter college transfer.

Learned counsel for the petitioner does not dispute that the relevant provisions as regards migration permitting inter college within the same university requires a particular examination to be passed which the petitioner had attempted but could not succeed. 9.

In the backdrop of the aforesaid factual situation, it does not appear that this Court can help the petitioner. The petitioner has raised his grievance very late and therefore, this Court declines interference. The petition is accordingly dismissed.
