CHANDIGARH CRM M-30771 of 2015 Date of decision : 10.09.2015 Saikul ....Petitioner V/s State of Haryana ....Respondent BEFORE : HON'BLE MR. JUSTICE RAJAN GUPTA

Present:

Mr. Satish Chaudhary, Advocate for the petitioner. RAJAN GUPTA J.

This is a petition filed under section 438 Cr.P.C. seeking pre-arrest bail in a case registered against the petitioner vide FIR No. 142 dated 13.04.2015 under Sections 376D/354C IPC and sections 66E/67A of the Information Technology Act, 2000 at Police Station Tauru, district Mewat.

Learned counsel for the petitioner submits that petitioner is not guilty of any offence. He has been falsely implicated in the case. Thus, he deserves the concession of anticipatory bail.

I have heard learned counsel for the petitioner. According to prosecution version, on April 13, 2015, Inspector Ashok Kumar alongwith other police officials were present at roundabout Nuh Road, Tauru. At that time, Sakir, Liyakat and Dewan Khan met Inspector Ashok Kumar and showed him a video clipping through whatsapp wherein accused Sakir with the help of Saikul (petitioner herein) forcibly committed rape on an unknown lady while accused Ballu made movie on his mobile. CRM M-30771 of 2015 ensued thereafter. Petitioner has prayed for bail on the ground that no specific role is attributed to him. I am not convinced with this plea. In my considered view, allegations in the FIR are serious. Crime of this nature is on the rise which has to be curbed. No case for grant of anticipatory bail is made out.

No merits. Dismissed.
