    Through this application, the petitioner (wife) prays for transfer of the petition under Section 13 of the Hindu Marriage Act, 1955, from the Court of the Principal Judge, Family Court, Gurdaspur to the Court of competent jurisdiction at Amritsar.

It has been pointed out that the petitioner is residing with her aged parents and the respondent is already defending a petition under Section 125 Cr.P.C. at Amritsar. It has further been pointed out that the petitioner is also looking after her minor son although, she has no independent source of income.

Keeping in view the aforesaid facts, the application is allowed. The case titled as 'Rakesh Kumar Vs. Ramandeep Kaur' pending in the Court of the Principal Judge, Family Court, Gurdaspur is ordered to be transferred to the Court of competent jurisdiction at Amritsar. TA-496-2021 (O&M) requested to remit the case file to the transferee Court forthwith. Parties are directed to appear before the District Judge, Amritsar on 06.09.2021, who will either decide the matter himself or assign it to the Court of competent jurisdiction at Amritsar.
