The prayer in the present petition filed under Articles 226/227 of the Constitution of India is for the issuance of a writ of Habeas Corpus directing respondent No.4 to produce the alleged detenue, aged about 3 and a half years, namely Gurtaj Deep Singh, son of Joban Singh and hand over the custody to the petitioner.

The learned counsel for the petitioner, at the very outset, submits that he wishes to withdraw the present petition with liberty to the petitioner to avail her remedies before the appropriate Court. 3.

In view of the prayer made, the present petition is disposed of with the directions that in case the petitioner moves an application before the appropriate Court within a period of 04 weeks, the said Court shall decide the application of the petitioner seeking custody of the child within a period of 03 months thereafter.

All the pending miscellaneous applications, if any, stand disposed of.
