Petitioner had faced the trial under Section 61(1)(a) of Punjab Excise (Haryana Second Amendment) Ordinance 1996 ('of the Act) for short) in FIR No.52, dated 24.01.1997, registered at Police Station Sadar, Sirsa. Trial Court vide judgment/order dated 27.05.2004/28.05.2004 ordered the conviction and sentence of the petitioner under Section 61(1)(a) of the Act. Aggrieved against the said judgment/order of his conviction and sentence, petitioner preferred an appeal and the same was dismissed by the Appellate Court vide order dated 14.09.2007. Hence, the present petition by the petitioner.
