HARSH BUNGER, J. (ORAL) Application bearing CM-12479-CWP-2024 has been filed on behalf of the Municipal Corporation, Chandigarh (respondent No. 2) seeking disposal of the writ petition on the ground that the same has been rendered infructuous, in view of the fact that order dated 13.03.2024 (Annexure P-25), which has been challenged in the afore-said writ petition (CWP-8251-2024), has already been withdrawn vide order dated 22.05.2024 (Annexure R-1).

Sanjiv Gupta, Advocate, appearing for the non-applicant/petitioners accepts notice of this application and does not dispute the fact that the order impugned in the writ petition already stands withdrawn vide above-referred order dated 22.05.2024 (Annexure R-1) passed by the Commissioner, Municipal Corporation, Chandigarh. further submits that he may be permitted to withdraw the writ petition (CWP-8251-2024) at this stage, however, with liberty to file a fresh one in case any of the grievance(s) of the petitioner still survives. 4.
Though the writ petition bearing CWP-8251-2024 is listed for hearing on 13.11.2024, however, on oral request of learned counsel for the non-application/petitioner, the same is taken up on Board today itself. 5.
In view of the afore-said submission made on behalf of learned counsel for the writ petitioners, the writ petition is ordered to be dismissed as withdrawn, however, with liberty to the petitioners to file a fresh one, in case, any of the grievance(s) of the petitioners still survive. 6.
Disposed of accordingly.
