Ms. Gauri C. Kaushal, Advocate has put in appearance on behalf of the appellant and informs the Court that Sh. Ravinder Chopra, Senior Advocate through whom this appeal was filed, has since expired. 2.

Apart from above, as reported by the Registry the notice issued to the appellant has been received back with the report that appellant has expired and notice issued to the respondent has been received back with the report that he refused to accept the notice with the remarks that he do not want to proceed further in this appeal. None of the legal heirs of the appellant has come forward to be impleaded as a party. 3.

Even otherwise, a perusal of the record shows that dispute related to an Atta Chakki which was being run with a diesel engine. Suit for mandatory injunction was dismissed by the trial court and appeal of the plaintiff was accepted.

Considering the fact that no representative of the appellant has come forward so as to pursue this appeal, the present appeal is dismissed in default for want of prosecution, with liberty to the aggrieved party to approach this Court, in case any cause of action still survives.
