**** AMARINDER SINGH GREWAL, J. (Oral) 1.
Learned AAG, Punjab has filed a status report, which is taken on record. As per the report, compliance of the order dated 28.11.2024 passed by this Court has been duly effected.
2.
The status report reveals that the SHO, Police Station Kharkhoda (Sonipat), was directed to verify the legal representatives of the deceased appellant. During the course of inquiry, the statement of the brother of Sultan was recorded. He stated that he had three brothers, namely Sultan, Ram Dhari and Jagphool, and two sisters, namely Jaalo and Pataso, both of whom have already expired. He further stated that his brother Sultan had three sons and one daughter. One son, namely Jagdish, has died; another son, namely Vinod, has also expired; and the third son, namely Kuldeep, has been missing for the last six to seven years. The daughter, -1SHUBHAM 2026.04.06 17:19 I attest to the accuracy and authenticity of this document/order
RSA-2259-1998(O&M) Saroj, is married. He further stated that Sultan had filed the present case before this Court against Om Parkash and others; however, he and his family members do not wish to pursue the present appeal. 3.
From the above factual position, it is evident that the original appellant has expired long back; his legal representatives, namely Jagdish and Vinod, have also expired; another son, Kuldeep, has been missing for the last six to seven years; and the remaining family members have expressly conveyed their unwillingness to pursue the present appeal. 4.
In view of the above, the present appeal is dismissed for nonprosecution, with liberty to the legal representatives of the appellant to seek revival of the appeal in case any cogent cause of action survives. 5.
