The petitioner seeks transfer of criminal appeal bearing No.CRA-141, dated 16.2.2023, which is currently pending in the Court of learned Sessions Judge, Ludhiana to any other district.

The specific ground raised in the petition for transfer of the aforesaid appeal is that the respondent Jatinder Singh Mahal is a practicing Lawyer at District Courts, Ludhiana.

Pursuant to issuance of notice of motion, Mr. Rajesh Gupta, Advocate has put in appearance on behalf of the respondent and has filed Vakalatnama, which is taken on record.

Having heard the learned counsel for the petitioner, this Court is of the opinion that it will be appropriate that the aforesaid appeal is transferred from PANKAJ KAKKAR 2023.05.16 14:37 I attest to the accuracy and authenticity of this document
CRM-M-19477-2023 (O&M) ( 2 ) 2023:PHHC:070420 Sessions Division, Ludhiana to any other neighbouring district keeping in view the fact that the respondent is a practicing Lawyer at District Courts, Ludhiana as is not been disputed by learned counsel representing the respondent. The instant petition, as such, is allowed and the appeal bearing No.CRA-141, dated 16.2.2023, which is currently pending in the Court of learned Sessions Judge, Ludhiana is ordered to be transferred to the Sessions Division, Moga. The Court concerned at Ludhiana shall send complete record of the appeal bearing No.CRA-141, dated 16.2.2023 to the District Courts at Moga within a period of 2 weeks from today.

Learned Sessions Judge, Moga may either himself decide the aforesaid appeal or entrust the same to any other Court of learned Additional Sessions Judge as deemed appropriate.

Needless to mention that the Court concerned at Moga shall dispose of the aforesaid appeal expeditiously.
