Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in case FIR No. 105 dated 22.08.2014, registered under Section(s) 15/61/85 of the Narcotic Drugs & Psychotropic Substances Act, 1985 at Police Station Sardulgarh, District Mansa. Learned counsel for the petitioner contended that petitioner was allegedly found to be in possession of 10 kgs. poppy husk and was admitted to bail by the learned trial Judge, but his bail was cancelled on 16.01.2019 as he failed to put in appearance before the learned trial Court and his nonbailable warrants of arrest were ordered to be issued. Learned counsel further contended that the reason for absence of the petitioner before the learned trial Court on 16.01.2019 was death of his younger brother, which took place on 21.12.

2018 and his death certificate is available on record as Annexure P3; the circumstances were beyond his control and now he is ready to surrender before the learned trial Court and furnish fresh bail bonds. DEEPAK KUMAR BHARDWAJ 2019.04.

On asking of the Court, Mr. Ajay Pal Singh Gill, Deputy Advocate General, Punjab accepts notice on behalf of respondent. A copy of paper-book be provided to him during the course of the day. In view of the facts detailed above, present petition stands disposed of with the directions that in case petitioner surrenders before the learned trial Court within a period of one week from today and moves an application for admitting him to bail, the learned trial Judge shall release him on bail on his furnishing fresh bail bonds and surety bonds.
