Prayer made in the present petition is for quashing of show cause notices dated 24.05.2002 and 13.09.2002 and to declare the petitioner having voluntarily retired from 19.07.2002.

Learned State counsel while referring to opening paragraph of the preliminary submissions of written statement, states that the petitioner having given notice for retirement on 03.07.2002 was rightly retired in terms of the Rules with effect from 03.10.2002 and prior thereto the show cause notices had been issued, to which he did not respond and even failed to also appear before the punishing authority on 08.10.2002.

There is no replication filed to controvert the aforesaid. 4.

In the wake of the above, the present petition stands disposed of
