This Court has heard the rival submissions made by learned counsel for the parties at considerable length. 7.

The petitioner who was working as a computer operator/ Arogya Mittar at Civil Hospital, Budhlada on contract basis and was assigned the duty of filling forms on computer/website of the department, is alleged to have prepared cards under the Chief Minister Health Scheme for providing free treatment upto Rs. 10,00,000/-. The allegations are that the scheme has not even been implemented by the State government at the time when he had prepared the cards in favour of two persons namely Bhagwant Singh and Ranjit Kaur and there were no guidelines with regard to preparing cards. The allegations against him make out a case of misuse of his power and defrauding the government. For the purpose of conducting thorough and proper investigation in the matter, custodial interrogation of the petitioner is required.        2

#he powers of anticipatory bail are extra ordinary and the same are to be exercised sparingly and in exceptional circumstances. The Court

CRM-M-14695-2026 -4must be circumspect while exercising such power for grant of anticipatory bail and it should not be granted as a matter of rule and has to be granted only when the Court is convinced that exceptional circumstances exist to resort to that extra ordinary remedy. In the present case, no such exceptional circumstances warranting exercise of the powers for grant of anticipatory bail by this Court are existing.
