Present petition filed by petitioner under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.09 dated 28.02.2015, under Sections 307/34 IPC and Section 302 IPC added later on, registered at Police Station Sanaur, District Patiala.

Learned counsel for the petitioner submitted that petitioner is ready to join the investigation and she is not running away from the Court. She is not concerned with matrimonial affairs of deceased and she is 'jethani' of deceased. So, she be released on anticipatory bail. 3.

Learned State counsel submitted that as per dying declaration of deceased Asha Rani, recorded by Magistrate, there are specific allegations against petitioner, who is 'jethani' of the deceased that she along NARESH KUMAR 2015.10.17 10:48 I attest to the accuracy and integrity of this document Chandigarh

CRM-M No.30897 of 2015 -2with co-accused used to beat her. As per above referred dying declaration, the petitioner along with co-accused set her ablaze after pouring kerosene oil upon her. As such, the petitioner is the main accused for commission of offence on the basis of dying declaration.
