**** JAISHREE THAKUR, J. (ORAL) This is a petition under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case FIR No.78 dated 28.06.2016 under Sections 326, 324, 323, 498-A, 34 IPC, registered at Police Station Guruhar Sahai, District Ferozepur.

This Court was pleased to pass the following order on 22.09.2016 :- "Amended memo of parties has been filed and the same is taken on record.

Post the matter before Mediation and Conciliation Center of this Court for 26.10.2016.

Parties are directed to appear before the Mediation and Conciliation Center on the date fixed.

Report be awaited for 23.2.2016.

Petitioner would pay Rs. 20,000/- to respondent No. 2 as medical expenses.

In the meanwhile, the petitioner is directed to join the investigation and if he is sought to be arrested, he shall be released on bail to the satisfaction of the arresting/investigating officer subject to the conditions laid down in section 438 sub section 2 clauses (i)(ii) and (iii) of the Code of Criminal Procedure."

CRM-M-31794-2016 -2Learned counsel for the petitioner contends that the petitioner is the elder brother of the husband of the complainant and pursuant to the order dated 22.09.2016, he has already joined the investigation. It is further contended that the challan has been presented and the proceedings under the FIR are ongoing.

Learned counsel for the respondent-State confirms the aforesaid fact.

Since the petitioner has joined the investigation, the petition is allowed and interim order dated 22.09.2016 is hereby made absolute subject to the condition that the petitioner will not tamper with evidence or hamper the investigation; will not leave India without permission of the Court and will comply with the conditions contained in Section 438(2) Cr.P.C. 14.11.2017 (JAISHREE THAKUR) Satyawan JUDGE Whether speaking/reasoned Yes.
