M.M.S. BEDI, J (ORAL) Petitioner along with three others had allegedly stopped the Indica car of complainant Manjit Singh a Head Constable and attacked him by firing to commit the robbery. The allegation of the prosecution is that the complainant was held by two boys while third one robed his wallet containing ATM Card and a sum of Rs.2,000/-. The petitioner had allegedly robbed the complainant of his wallet, ATM Card and a sum of Rs.2,000/- The complainant has already been examined. It is a case of no injury though there are serious allegations of firing. Two co-accused of the petitioner have been granted the concession of bail.
On the basis of principle of parity, the petitioner also in said circumstances can be granted the concession of bail as chance of tampering with evidence is remote.
The petition is allowed. Petitioner is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of the trial Court.
