Petitioner has filed this petition under Section 439 of the Code of Criminal Procedure, 1973 seeking regular bail in FIR No. 37 dated 30.5.2015 under Section 22 of Narcotic Drugs and Psychotropic Substances Act, 1985 ('Act' for short), registered at Police Station Jaurkian, District Mansa, Punjab. Heard.

Admittedly, recovery of the contraband, effected from the petitioner, falls in non-commercial quantity. Petitioner is in custody since 30.5.2015.

On a query put by this Court, learned State counsel, who is assisted by Head Constable Jarnail Singh, has submitted that petitioner is not involved in any other case under the Act. Accordingly, without expressing any opinion on the merits of the case, this petition is allowed. Petitioner be admitted to bail subject to the satisfaction of Chief Judicial Magistrate, Mansa.
