This is a petition filed under Section 438 of the Code of Criminal Procedure seeking pre-arrest bail in a case registered against the petitioners vide FIR No. 317 dated 27.06.2017 under sections 323, 324, 34, 506 IPC & section 325, 326 IPC added later on at Police Station Kharkhoda, district Sonepat.

Learned State counsel submits that injury attracting offence under section 326 IPC is attributed to petitioner no. 4-Rajender Dahiya. Same is serious in nature having been inflicted on vital part of the body. In view of nature of injuries attributed to petitioner no. 4, he is not entitled to concession of pre-arrest bail. Petition is dismissed qua petitioner no. 1Rajender Dahiya. As regards, petitioners no. 1 to 3, learned State counsel submits that they have joined the investigation and are not required by the investigating officer.
