Challenge in the present revision petition is to the order dated 22.05.2018 (Annexure P-13) passed by the Trial Court partly allowing the application of the plaintiff-petitioner under Order 39 Rules 1 and 2 of the Code of Civil Procedure, 1908. Aggrieved by the same, both the plaintiff and the defendants had filed appeals before the First Appellate Court and both the appeals were dismissed vide the order dated 20.11.2018 (Annexure P-18). Aggrieved by the same, the present revision petition has been preferred only by the plaintiff. The defendants have not challenged the order dismissing their appeal.

Learned counsel for the plaintiff-petitioner at the outset states that since the suit is at the fag end, hence, he does not wish to press the present petition. He, however, prays that the Trial Court be directed to expedite the hearing of the suit.

In view of the above, the present revision petition is dismissed as not pressed. However, the Trial Court is requested to expedite the hearing of the matter in accordance with law and not grant any unnecessary adjournments to either of the parties. Pending applications, if any, also stand disposed off.
