As per allegations levelled by the father-complainant of the injured Mohit, Ashok Taneja and his friends armed with iron rods and dandas intercepted his son Mohit at around 8 pm and after encircling inflicted injuries.

It is contended that the petitioner is in custody since 11.6.2015 and after investigation challan has been presented. The role attributed to petitioner is that he inflicted a danda blow on the right leg of the injured which resulted in fracture of the right leg. It is further contended that even injury on the head attributed to Ashok Taneja, till RAJINDER PRASHAD JOSHI 2015.09.28 16:49 I attest to the accuracy and authenticity of this document High Court, Chandigarh.

CRM-M 30960/2015 date has not been opined to be grievous to life. Learned State counsel on instructions from ASI Surinder Singh is unable to controvert the aforesaid factual position. Without expressing anything on the merits of the case, keeping in view the fact that trial is not likely to be concluded in near future and no useful purpose would be served by keeping the petitioner in custody, the present petition is allowed and petitioner is directed to be released on bail subject to the satisfaction of CJM/Duty Magistrate,Hisar.
