RAJESH BHARDWAJ, J.(ORAL) Instant petition has been filed under Section 438 Cr.P.C. praying for grant of anticipatory bail to the petitioner in complaint case No.55 of 2018, dated 03.11.2017 under Section 138 of Negotiable Instrument Act titled as 'Sukhminder Singh versus Davinder Singh and Company', in which petitioner has been declared proclaimed person vide order dated 31.01.2020, Annexure P2.

Learned counsel for the petitioner fairly submits that in the complaint filed under Section 138 of the Negotiable Instrument Act, the petitioner was erroneously declared as proclaimed person. However, after arguing for some time, counsel for the petitioner submits that he may be allowed to withdraw this petition with liberty to the petitioner to surrender before the Court concerned and file an appropriate application for grant of bail.

Allowed as prayed for.
