ORAL 1.

On 19.03.2026, the following order was passed:- "Petitioner, an accused in case FIR No.326 dated 13.12.2025, registered against him, for commission of offence punishable under Sections 333, 115(2), 191(3), 190, 324(4) BNS, at Police Station Talwandi Sabo, District Bathinda, has prayed for grant of pre-arrest bail.

Learned counsel for the petitioner contends that petitioner, a young boy, has been falsely implicated in the present case. The incident did not occur as portrayed by the complainant party. In fact, it's being a case of version and cross-version, it is yet to be ascertained as to which of the parties were the aggressor. In any case, even if the story as portrayed by the complainant is taken to be true at its face value (though not admitted), the only role attributed to the present petitioner is that he was present at the site along with other assailants when the alleged incident occurred and was armed with 'Kirpan', but no specific overt act has been attributed to him. Heard. Documents on record perused.

Notice of motion.

Mr. Kamalpreet Bawa, DAG, Punjab, accepts notice on behalf of respondentState and seeks time to file detailed status report. Adjourned to 06.05.2026.

Investigating Officer of the case is directed to place on record the MLR of both the parties.

Till the next date of hearing, no coercive steps be taken against the petitioner." 2.

On 06.05.2026, the following order was passed:-

"Raising submission further, as recorded in the order dated 19.03.2026, learned counsel for the petitioner has urged that the petitioner is a man with clean antecedents & is willing to join investigation and cooperate therein as per law.

List on 27.05.2026.

The petitioner is directed to appear before the Investigating Officer on 09.05.2026 at 11:00 A.M. in concerned Police Station and join investigation. In the event of arrest, the petitioner shall be released on interim bail subject to his furnishing personal/surety bond(s) to the satisfaction of the Arresting Officer/Investigating Officer. As and when further called by Investigating Officer, the petitioner shall join the investigation. He shall abide by the condition(s) enumerated under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023."

Learned State counsel, on instructions, has stated that pursuant to the order dated 19.03.2026 and 06.05.2026 the petitioner has joined investigation and is no longer required for custodial interrogation. 4.

Keeping in view the factual milieu of the case in hand; especially the factum of the petitioner having joined investigation and cooperated therein and is no longer required by the State for further custodial interrogation, this Court is inclined to confirm the order dated 06.05.2026 granting anticipatory bail to the petitioner, subject to the conditions as enumerated under Section 482(2) of BNSS. 5.

Ordered accordingly.

This order should not be treated as "blanket" order. It will not be read granting petitioner indefinite protection from arrest. It shall be confined to the FIR mentioned ibid and will not operate in respect of any other incident that involves commission of an offence. 7.

Liberty is reserved in favour of State/complainant to move for cancellation/recall of this order in case the petitioner violates any condition stipulated under Section 482(2) of BNSS, 2023 or upon showing any other sufficient cause.

Needless to say that anything observed herein above shall not be construed to be an opinion on the merits of the case. 9.
