Learned State counsel has insisted that the trial is at penultimate stage and that the case is fixed for defence evidence. I have considered the facts and circumstances of the case. The petitioner, as a member of an unlawful assembly, is alleged to have forcibly occupied and taken away the car of Shekhar Chand complainant. All the prosecution witnesses stand examined. It will not be appropriate for this court to enter into the niceties of the trial by appreciating the evidence lest it should prejudice the case of the petitioner or the prosecution. The petition is disposed of with a direction that in case the trial is not concluded within a period of 45 days after the next date of hearing fixed before the trial court, it will be open to the petitioner to approach this court again for grant of regular bail.
