******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.71 dated 30.11.2017 registered for the offence punishable under Section 302 of Indian Penal Code, at Police Station Purana Shalla, District Gurdaspur.

Heard.

Learned counsel for the petitioner submits that the petitioner has surrendered before the trial Court and has been released on interim bail. Learned State counsel on instructions from ASI Ranjit Singh submits that the petitioner has surrendered before the trial Court and joined the proceedings. His custodial interrogation is no more required for the purpose of further investigation of the case. In view of submission of learned State counsel but without expressing any opinion on the merits of the case, this petition is allowed and order dated 30.07.2018 is made absolute, subject to the following terms:- JITENDER KUMAR 2018.10.15 16:02 I attest to the accuracy and integrity of this document Chandigarh

(ii) that the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against him so as to dissuade him from disclosing such facts to the Court or to any police officer;

(iii) that the petitioner shall not leave India without the prior permission of the Court.
