RAMENDRA JAIN, J. (ORAL) Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner Jasbir Singh alias Sona in a case arising from FIR No.65 dated 04.04.2018 registered under Section 21 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station City Patti, District Tarn Taran.

According to the prosecution, on 04.04.2018 petitioner was apprehended with 256 grams of heroin.

Learned counsel for the petitioner inter alia contends that FSL report has not yet been received. Therefore, it cannot be said that recovered article from the petitioner was heroin. Petitioner is in custody since 04.04.2018.

In view of above, but without expressing any opinion on the merits of the case, the petitioner is granted interim bail subject to furnishing personal bonds and two sureties of ` 2.00 lakh each, to the satisfaction of Special Court concerned only till receipt of the FSL report. The petition stands disposed of accordingly.
