RAMENDRA JAIN, (ORAL) At the outset, learned counsel for the appellant submits that in view of order of even date passed in connected RSA-1799-1999, the instant appeal may be allowed in the same terms, as per compromise effected in between the parties.

In view of the above, the instant regular second appeal is allowed in terms of order of even date passed in connected RSA-1799-1999. Impugned judgment and decree of lower Appellate Court dated 22.09.1998 is set aside and that of trial Court dated 31.07.1995 in favour of appellantWakf Board, is affirmed. Decree sheet be prepared accordingly.
