Mr. Sandeep, Additional Advocate General, Punjab. *** After arguing for some time, learned counsel for the appellant states that he permitted to withdraw the appeal granting him liberty to approach the authorities under the Punjab Municipal Act, 1911 by way of filing an appeal. Permission is granted. The appeal is dismissed as withdrawn. The appellant may file appeal against the impugned order before the competent authority under the Punjab Municipal Act, 1911 and on appellant doing so the Appellate Authority may condone the delay in filing of the appeal for the reason that the appellant has spent considerable time in filing and pursuing the civil suit and then filing appeal before District Court at Barnala.

The Appellate Authority is to decide the appeal by independent application of mind without being influenced by any finding given by the trial Court and learned District Judge, Barnala. (H.S.
