Learned State counsel has submitted that local police has recommended cancellation of the F.I.R. in that way the petitioner is not required to be arrested in this case. He further submits that if as a result of further investigation or enquiry, the petitioner is required to be arrested in this case then the local police would give 7 days advance notice to him. In view of the statement made by the State counsel, the petition has become infructuous and is dismissed accordingly. Learned counsel for the petitioner has submitted that Passport of petitioner which had been surrendered before the local police be ordered to be returned to him. Learned State counsel states that it would be so done on petitioner approaching the local police and issuing necessary receipt. (H.S.
